Terms of Service
If my terms are broken, you will be blocked and blacklisted.Art Terms:
1. You may repost my art or use it as a profile image as long as it is your commission or character. I ask that my art is credited, either by tagging me on that site or with my ToyHou.se @Sugarghosts. I do not consider it required for profile images (icon or banner) but it is heavily appreciated.2. Do NOT steal, trace, recolour or copy my artwork or designs. Even if you commissioned the artwork or own the character in it.3. You can make minor edits to my art if you either commissioned it or own the character within my artwork, however, it is not to be edited to be a different character or to include discrimination or hateful content.
3.5. Acceptable edits can include design updates, editing characters name/pronouns/etc on refs and other small changes. If you're unsure, ask first. I am also often willing to do edits of my art for you for free, just ask. Keep in mind I am not obligated to do this and I will not make major changes.4. I retain rights to my artwork, I may post it or use it as an example unless explicitly requested for it to be kept private. If you want to purchase the commercial rights to my artwork, contact me.5. I will NEVER allow my artwork to be used as NFTs or used in/for AI software.6. I do NOT do refunds unless there are special circumstances.Design Terms:
1. You cannot adopt a character from me without a ToyHou.se account. I do not allow you to trade or sell my designs offsite. I can provide invite codes if needed. Character profiles must not be deleted from the site without notifying me first.2. Do NOT resell adopts for more than their worth. If you received them for free, you cannot sell or trade them without additional art. Giving them away for free, as a gift or raffling them is always okay. I also do not mind freebie swaps.
2.5 As a general rule, commissioned art, art obtained via trade and personal art ALL count as additional art, free art does not. Though, it's ultimately up to the individual artist what their art is worth.3. Do NOT use my designs for the creation of hateful or discriminatory content. NSFW with my designs is allowed as long as it is not visible to minors and is of adult anthro or humanoid characters. I do not support or endorse underage or feral NSFW content.4. You can always redesign my designs as long as you do NOT detransition trans characters, race-swap POC (or POC-coded) characters, remove scars or remove visible disabilities.
4.5. Regarding trans characters, you may always change their gender identity and pronouns as long as they remain trans.Commission Terms:
1. I have the right to decline a commission or request a character change for any reason.2. I prefer to contact you using Discord when I'm doing commissions or owed art. However, I am also willing to use ToyHou.se to contact you.3. I only do major edits (pose, complete outfit change, etc.) when the piece is in the sketching phase. Ask about other edits, it will depend on how much will need to be changed if I can do it.4. You can always ask for edits after completion but please understand that I am not obligated to after 7 days have passed.5. You can expect your artwork to be completed within a week.Regarding Commercial Rights:
For artwork, you must purchase commercial rights separately. You may request commercial rights upon requesting a commission or anytime after completion.
For designs, you may use the design commercially as commercial rights come with the design. However, you can not use my artwork of said design commercially! Commercial rights for the artwork must be purchased separately just as for commissioned art.Regarding Payment:
I ONLY take Paypal or payments through Ko-Fi currently. I take full payment after the sketch is completed, however, payment plans can be arranged if required. I take USD unless otherwise stated.By purchasing a commission or character design you are hereby agreeing to the terms expressed above.
